By now, you’ve heard all about marijuana legalization and decriminalization. As of this writing, for example, 14 states and territories have legalized marijuana, including but not limited to Alaska, Colorado, California, Nevada, Maine, Illinois, Vermont, Washington, Oregon, and Massachusetts. On top of that, many other states have softened their marijuana possession laws to a significant degree.
So, what about Texas? Has it legalized marijuana or at least made its punishments a lot less harsh for adults who possess the drug for personal use? Unfortunately for marijuana supporters and users, Texas is NOT one of the states that have decriminalized or legalized pot. It’s still highly illegal in the Lone Star State, so Texans have to be aware of the state’s marijuana laws and the consequences of being caught.
Texas’ Marijuana Laws & Penalties
In Texas, you face the following penalties if you are caught with marijuana:
- Possession of 2 ounces or less is a misdemeanor, punishable by 180 days in jail and a maximum fine of $2,000.
- Possession of 2 to 4 ounces is a misdemeanor, punishable by 1 year in jail and a fine not to exceed $4,000.
- Possession of 4 ounces to 5 pounds is a felony, punishable by 180 days to 2 years behind bars, and a fine not to exceed $10,000.
- Selling 7 grams or less without payment is a misdemeanor, punishable by 180 days in jail and a fine not to exceed $2,000.
- Selling 7 grams or less is a misdemeanor, punishable by 1 year in jail and a fine not to exceed $4,000.
- Selling 7 grams to 5 pounds is a felony, punishable by 180 days to 2 years and a fine not to exceed $10,000.
- Possession of paraphernalia is a misdemeanor, punishable by a $500 fine.
- Cultivation is punished according to the total weight of the plants found by law enforcement. Ask your attorney about “possession” for additional information.
